DATAMINION End User Agreement

This End User Agreement ("Agreement") is entered into between you ("User" or "You") and DATAMINION ("Company" or "We"), governing your use of DATAMINION's software as a service ("Service") available at www.dataminion.ai. By accessing or using the Service, you agree to be bound by the terms and conditions of this Agreement. If you do not agree to these terms, you may not use the Service.

1. License Grant
Subject to the terms and conditions of this Agreement, DATAMINION grants you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal or commercial use during the term of this Agreement.

2. User Responsibilities

2.1 Compliance: You agree to comply with all applicable laws, rules, and regulations in connection with your use of the Service.

2.2 Registration: You may be required to register an account with DATAMINION in order to access certain features of the Service. You agree to provide accurate, current, and complete information during the registration process and to update such information as necessary to keep it accurate, current, and complete.

2.3 Security: You are responsible for maintaining the security of your account credentials and for all activities that occur under your account. You agree to immediately notify DATAMINION of any unauthorized use of your account or any other breach of security.

3. Use of Service

3.1 Authorized Use: You may use the Service only for its intended purpose as described on the DATAMINION website.

3.2 Prohibited Conduct: You agree not to:
• Use the Service in any unlawful manner or for any unlawful purpose.
• Upload, post, or transmit any content that is infringing, libelous, defamatory, obscene, pornographic, abusive, or otherwise objectionable.
• Attempt to gain unauthorized access to any portion or feature of the Service, or any other systems or networks connected to the Service.• Interfere with or disrupt the operation of the Service or any servers or networks used to provide the Service.

4. Fees and Payment

4.1 Subscription Plans: DATAMINION offers two primary subscription plans: Premium and Professional. Details of these plans, including pricing and features, are available on the DATAMINION website.

4.2 Payment: You agree to pay all fees associated with your selected subscription plan in accordance with the payment terms specified by DATAMINION. Payment obligations are non-cancelable and fees paid are non-refundable.

5. Intellectual Property

5.1 Ownership: You acknowledge that DATAMINION owns all right, title, and interest in and to the Service, including all intellectual property rights therein.

5.2 Feedback: If you provide DATAMINION with any feedback, suggestions, or ideas regarding the Service, you hereby grant DATAMINION a perpetual, irrevocable, royalty-free, worldwide license to use, modify, and incorporate such feedback into the Service.

6. Term and Termination

6.1 Term: This Agreement shall remain in effect until terminated by either party in accordance with this section.

6.2 Termination: DATAMINION may terminate this Agreement at any time without notice if you breach any provision of this Agreement. You may terminate this Agreement by ceasing to use the Service and deleting your account.

7. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. DATAMINION DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT.

8. Limitation of Liability
IN NO EVENT SHALL DATAMINION BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE USE OR PERFORMANCE OF THE SERVICE, WHETHER OR NOT DATAMINION HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

9. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the United States and the State of Washington, without regard to its conflict of laws principles.

10. Entire Agreement
This Agreement constitutes the entire agreement between you and DATAMINION regarding your use of the Service and supersedes all prior and contemporaneous agreements, representations, and understandings, whether written or oral.

11. Modifications
DATAMINION reserves the right to modify or update this Agreement at any time by posting the revised terms on the DATAMINION website. Your continued use of the Service after any such changes shall constitute your consent to such changes.

By using the Service, you acknowledge that you have read, understood, and agree to be bound by the terms and conditions of this Agreement. If you do not agree to these terms, you may not use the Service.
